charges as a result of a previous drug investigation which

CHILD
INJURED IN SHOOTING INCIDENT
On Friday, March 18th,
2011 at approximately 3:26 PM, the Darke County Sheriff's
Office was contacted by the Wayne County 9-1-1 Center
reporting they had received a call from the 1900 block of
Payne Road near Hollansburg, Ohio in reference to a six year
old female who had been shot in the abdomen. Upon arrival at
the scene, investigators confirmed that the child had
received a small caliber gun shot wound to the lower
abdomen.
The six-year old child
has been identified as Fayth Van Etten of 1997 Payne Road.
The child was transported by Tri-Village Rescue to Wayne
Health Care in Greenville, Ohio. The victim was later
transferred to Children's Medical Center of Dayton by MICU,
where she's expected to undergo surgery for the injuries
sustained in the incident. At last report, the condition of
the child was listed as stable for transport to Children's
Medical Center.
The initial
investigation indicates that while at her residence, 1997
Payne Road, the child was struck in the lower abdomen by a
projectile fired from a small-caliber rifle which was being
controlled by her father, William Baker, age 25 and also of
1997 Payne Road. The child's parents were both present at
the time of the incident. Preliminary reports suggest that
the injury to the child most likely resulted from a ricochet
of the projectile fired from the small-caliber rifle.
Also responding to the
scene was Hollansburg Fire Department. Care Flight was also
dispatched to the scene, but had to abort flight due to
weather conditions.
This incident will
remain under investigation by the Darke County Sheriff's

Last night Darke County

The

occurred during day time hours. There have also been
numerous burglaries reported across

citizens report any suspicious activity immediately to our

essence when reporting suspicious activity. When reporting
suspicious activity, any information available, such as
vehicle or person descriptions, should be reported to the on

The Darke County Sheriff makes the following suggestions to
reduce your chances of becoming a victim of crime. Lock the
doors to your vehicle, home and secure outbuildings. Do not
leave garage and outbuilding doors standing open
unnecessarily. This only advertises your valuables to
thieves that may be scouting your neighborhood for their
next victim. If you are going to be traveling on vacation or
away from your residence for several days, stop your mail

Chief Deputy Mark Whittaker

DARKE
COUNTY TO USE MODIFIED LEVEL 3 SNOW EMERGENCY
With the potential
impending winter weather Darke County Sheriff Toby L.
Spencer would like to remind the public of the snow level
advisories and introduce a modified level three snow
emergency. The
Darke County Sheriff will be using the latest technology in
an effort to keep the public informed and up to date on any
snow levels or traffic hazards.
Pursuant to the Ohio
Revised Code and Ohio Attorney General Opinion’s, the
Darke County Sheriff can declare snow emergencies and
temporarily close any county, township, state roadways or
municipal streets within his jurisdiction when necessary to
preserve the public peace.
Winter weather and
travel conditions are always changing.
The flat and rural nature of
Darke
County
’s geography lends itself to these dynamic situations.
The large size of
Darke
County
can often result in varying levels of conditions in the
county. As a
rule Sheriff Spencer issues advisories and emergencies based
on the overall conditions of the county as a whole.
The Sheriff makes decisions on what levels to issue
based on information received from a number of sources
including the National Weather Service, road deputies and
state, county and township road crews.
Public safety comes first when making such decisions.
With this in mind Sheriff Spencer plans to be more
conservative in his use of level three snow emergencies if
conditions permit. A
“Modified
Level Three” may be issued which will be more
geographically specific to areas with the most critical
problems. This
will also result in more use of the level 2 snow advisory
when weather and conditions dictate its use.
The “Modified
Level Three” if used will be issued with specific
instructions on what particular types of roads or areas of
the county are closed. This
will permit travel to occur in less affected areas of the
county or municipalities.
The Snow Level
Advisories/ Emergency are explained as follows:
LEVEL
1 SNOW ADVISORY
A
level one-snow advisory means that roadways are snow covered
and hazardous. Motorists are urged to drive very cautiously.
LEVEL
2 SNOW ADVISORY
A
level two-snow advisory means that roadways are hazardous
with blowing and drifting snow. Roads can be very icy. Only
those who feel it is necessary to drive should be out on the
roadways. People should contact their employer to see if
they should report to work. Obviously, if you are driving,
use extreme caution.
LEVEL
3 SNOW EMERGENCY
A
level three snow emergency means that ALL roadways
are CLOSED to non-emergency personnel. No one should
be driving during this condition unless it is absolutely
necessary or a personal emergency exists. All employees
should contact their employer to see if they should report
to work. Anyone traveling on the roads may subject
themselves to arrest.
MODIFIED
LEVEL THREE
A
modified level three snow emergency means that roadways or
types of roadways (state roads, county roads, township
roads, municipal streets) in a specifically designated
geographic area are CLOSED to non-emergency
personnel. No
one should be driving on these types of roads or in these
areas during this condition unless it is absolutely
necessary or a personal emergency exists.
All personnel in the affected area should contact
their employer to see if they should report to work.
Anyone traveling in the designated area may
subject themselves to arrest.
Sheriff Spencer will
communicate advisories/emergencies and any updates on their
status or cancellation via press releases to local media
outlets. In
addition, all advisories/ emergencies will be posted and
regularly updated on the Darke County Sheriff’s Office
website; http://www.darkecountysheriff.org.
When the website is updated or a status change occurs
this information is transmitted automatically to Facebook
and Twitter. This
enables the public to be notified almost instantaneously if
they choose. Sheriff
Spencer asks that citizens utilize these numerous
informational sources rather than call the Sheriff’s
Office to ask about snow level statuses.
In years past we have received numerous calls in the
dispatch center asking about snow level status and weather
conditions. Such
calls tie up emergency communication lines.
Sheriff Spencer urges
everyone to always wear a seat belt and have a safe and
happy holiday season.

look out and immediately report any suspicious activity they
might observe. Such activity can be reported to the Sheriff
24 hours a day by calling 937-548-2020. It is important that
reports are called in at the time they are observed to allow
the deputies a timely response and investigation. If able to
do so safely, please provide a description of any vehicles
or persons associated with the suspicious activity.
The Darke County Sheriff makes the following suggestions to
reduce your chances of becoming a victim of crime. Never
leave your keys in the car, remove valuable items and lock
your vehicle doors. Many of the motor vehicle thefts
involved was the result of owners leaving the keys in the
ignition. Lock the doors to your home and secure
outbuildings. Do not leave garage and outbuilding doors
standing open unnecessarily. This only advertises your
valuables to thieves that may be scouting your neighborhood
for their next victim.
The Darke County Sheriff encourages property owners to
record and document manufacturer names, model numbers and
serial numbers to their valuables. This information is
necessary to increase the chances of property recovery if
you should become a victim of crime and sustain a theft.
When citizens and law enforcement work together we make our
community a less attractive place for criminals and a safer
place to live and work.

the vehicle to go off the south side of the road into a
field. The vehicle overturned and rolled several times
ejecting Kaitlyn Moses from the vehicle. Delong and Baker
were seat belted in the vehicle and remained inside the
vehicle until it came to a final rest. At this time it is

MAN
FOUND DEAD AT FIRE
On April 13th, 2010
units from the Burkettsville Community Fire Department and
Rossburg Fire Department were dispatched to the area of
Lightsville Northern Road south of State Route 705 in
reference to a corn field fire. Southwest Mercer Fire
Department and Ansonia Rescue assisted with the fire. Fire
units arrived on scene and began fighting the fire, and a
short time later, discovered the body of a deceased
unidentified adult male subject within the fire perimeter.
Burkettsville Fire immediately contacted the Darke County
Sheriff's Office who started an investigation along with the
Darke County Coroner's Office.
An initial investigation
reveals that the unidentified male subject was apparently
attempting to burn a large brush pile on the property. It is
believed that the unidentified male subject may have been
using an accelerant to start the fire. It appears that the
male subject's clothing caught fire, causing the male
subject to fall down in the field, possible starting the
cornfield fire. At this time, the cause of death is pending
a forensic examination. The male subject is believed to be a
local land owner and formal identification of the male
subject is pending. An estimated twenty acres of land was
involved in the fire as well as a large brush pile.
This investigation is
still pending with the Darke County Sheriff's Office and the
Darke County Coroner's Office.

Numerous items of property including home electronics, cash

WINTER
WEATHER TRAVEL TIPS/INFORMATION
As winter approaches and
the chances of snow and inclement weather continue to
increase, the Darke County Sheriff’s Office and Sheriff
Toby L. Spencer want to encourage everyone to utilize safe
winter travel practices.
Use slower acceleration
and slower speeds. Avoid heavy steering and braking. Allow
extra time to reach your destination during inclement
weather.
- Drive
with your headlights on.
- Don't
get overconfident with four-wheel drive. It won't help you
stop any faster.
- Winter
road conditions often result in longer stopping
distances. Give yourself room. If you have anti-lock
brakes, press the pedal down firmly and hold it. If you
don't have anti-lock brakes, gently pump the pedal.
- Slow
down when approaching intersections, off-ramps, bridges or
shady spots. These all have potential to develop black
ice.
- Avoid
abrupt actions while steering, braking or accelerating to
lessen your chance of losing control.
- Look
farther ahead in traffic. Actions by other drivers will
alert you to problems and give you extra reaction time.
- Trucks
take longer to stop. Don't cut in front of them.
- Avoid
using cruise control or overdrive. Don't let your car make
a bad decision for you.
It is important to check
travel and road conditions before traveling. The Darke
County Sheriff’s Office new website (www.DarkeCountySheriff.org)
will have the latest information on any issued snow
emergencies. Snow emergency information is also passed on to
all local media including print and web media, local radio
stations and local television stations.
Snow Emergency
Definitions:
Level 1 Snow/Ice
Advisory: Roadways are slick and hazardous. Extra caution
should be used if traveling. Travel is not restricted.
Level 2 Snow Emergency:
Roadways are hazardous with blowing and drifting snow. Roads
can be very icy. Only those who feel it is necessary to
drive should be out on the roadways. People should contact
their employer to see if they should report to work.
Obviously, if you are driving, use extreme caution.
Level 3 Snow Emergency: ALL roadways
are CLOSED to non-emergency personnel. No one should
be driving during this condition unless it is absolutely
necessary or a personal emergency exists. All employees
should contact their employer to see if they should report
to work. Anyone traveling on the roads may subject
themselves to arrest.
If
at all possible, please avoid calling the Darke County
Sheriff’s Office for information concerning snow
emergencies and or road conditions. If inclement weather is
affecting the region, it is likely that the dispatch center
is overwhelmed with emergency calls.
